Collaboration Agreements

Cooperation agreements are agreements between the Administracióndel state and one or several Autonomous communities. Are, together with sectoral conferences, the instrument of cooperation more often used in the state Communities by contractual freedom characteristic of this figure, which gives it a special fitness and flexibility to fix the content of the agreements that want to reach the state and the Autonomous Communities.

Cooperation agreements have a basic regulation in chapter VI, preliminary title, the law 40 / 2015, 1 October, of Legal Regime of the public Sector, which establishes the requirements to be met. This regulation is complete, for the General administration of the state with the command PRA / 1267 / 2017, 21 December 2017, which publishes the agreement of the council of Ministers from 15 December 2017, approving the instructions for the processing of conventions.

Although formally the conveniossonconsiderados as instruments of cooperation bilateral in nature, in practice the government and different ministries gradually have idoimpulsando a multilateral approach to politics of conventions, proposing the same, oparecido text, all or a large part of the autonomous communities. A númerosignificativo deconvenios contains financial commitments by the state, so that in practice sonutilizados by the government to promote policies and concrete actions to carry out the autonomous communities. These inputs state budget complement the input of the autonomous communities and encourage the action lines of communities that the government is keen to encourage. Stand out for their importance the conventions in the area of social policies, infrastructures and environmental policies. In other cases the input of the parties are compensated for the activity carried out by an administration in benefit and on behalf of another different administration.
